Terms & Conditions

1. Acceptance of Terms
   By creating an account, placing an order, or using MXJek’s website/app/services (“Services”), you agree to these Terms & Conditions (“Terms”). If you do not agree, do not use the Services.
2. Who We Are
   MXJek operates a technology platform that connects customers with independent delivery partners and/or merchants. MXJek is not a common carrier and does not manufacture or control merchant products.
3. Definitions

• “Customer”: a user placing an order or using the Services.
• “Delivery Partner”: an independent contractor who accepts delivery requests via the platform.
• “Merchant”: a third party that prepares, sells, or supplies goods.
• “Order”: a request for goods and/or delivery placed through the Services.

1. Eligibility
   You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of entering a binding contract. For age-restricted products, a valid government ID is required upon delivery.
2. Account & Security
   You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use. MXJek may suspend or terminate accounts for suspected fraud, violations, or legal risk.
3. Service Availability
   Features and coverage areas may change or be limited due to maintenance, demand, weather, traffic, laws, or other factors. We may modify or discontinue any part of the Services at any time.
4. Orders, Pick-up & Delivery

• Order Confirmation: An order is confirmed when shown in your app/email. Estimated times are not guaranteed.
• Access & Instructions: You must provide accurate delivery instructions and be available to receive the order.
• No-Show/Undeliverable: If we cannot reach you or access the location, the order may be canceled or returned. Fees may apply.
• Verification: Delivery Partners may verify identity/age and refuse delivery if requirements are not met.
• Restricted/Unsafe: Orders may be canceled if items are illegal, unsafe, improperly packaged, or violate policy.

1. Fees, Pricing & Payments

• Displayed prices may include service fees, small order fees, surge/demand fees, delivery fees, taxes, and tips.
• You authorize MXJek (and its payment processors) to charge your selected payment method for all amounts due.
• We may correct pricing errors and either cancel or adjust the charge.
• Tips are optional and go to the Delivery Partner unless otherwise stated.
• Chargebacks or payment failures may result in account suspension.

1. Cancellations & Refunds

• You may cancel before a Delivery Partner or Merchant begins preparing/collecting the order. After that point, cancellation fees may apply and certain items may be non-refundable.
• If an order is incorrect, missing, damaged, late, or otherwise problematic, report it via support within a reasonable time with order ID and evidence (photos, notes). Resolutions may include redelivery, partial/full credit, or refund at MXJek’s discretion and subject to applicable laws.

1. Promotions, Credits & Gift Codes
   Promos and credits are single-use, non-transferable, not redeemable for cash, and may expire. We may limit, revoke, or modify offers suspected of abuse or error.
2. User Conduct
   You agree not to:

• Misuse the Services, interfere with operations, or attempt to bypass security.
• Reverse-engineer, scrape, or use automated means without permission.
• Post unlawful, infringing, defamatory, obscene, or misleading content.
• Harm or harass Delivery Partners, Merchants, or other users.

1. Ratings, Reviews & Feedback
   By submitting feedback, you grant MXJek a perpetual, worldwide, royalty-free license to use, display, and share it for any purpose, in compliance with applicable laws and our Privacy Policy. We may remove content that violates these Terms.
2. Third-Party Services & Merchants
   Links to third-party sites/services are provided for convenience. MXJek is not responsible for their content, policies, or product quality, and does not guarantee availability or suitability of merchant items.
3. Delivery Partners
   Delivery Partners are independent contractors, not employees or agents of MXJek. MXJek is not responsible for a Delivery Partner’s conduct beyond what is required by law and platform rules. Safety-related concerns should be reported immediately.
4. Intellectual Property
   The Services, including logos, trademarks, text, graphics, software, and content, are owned by or licensed to MXJek and protected by law. You receive a limited, revocable, non-transferable license to use the Services for personal, non-commercial purposes.
5. Privacy
   Your use of the Services is also governed by the MXJek Privacy Policy, which explains what data we collect and how we use it. Please review it carefully before using the Services.
6. Communications Consent
   You consent to receive transactional emails, SMS, and in-app notifications about orders and account activity. You may opt-out of marketing communications at any time (transactional messages will still be sent as needed for your orders).
7. Warranties Disclaimer
   To the maximum extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement. Estimated delivery times are not guarantees.
8. Limitation of Liability
   To the maximum extent permitted by law, MXJek and its affiliates will not be liable for indirect, incidental, punitive, special, or consequential damages, or loss of profits, data, goodwill, or business, arising from or related to your use of the Services, even if advised of the possibility. Our total aggregate liability for any claim will not exceed the greater of (a) the amount you paid for the order giving rise to the claim or (b) USD 100 (or equivalent).
9. Indemnification
   You agree to defend, indemnify, and hold harmless MXJek, its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your breach of these Terms, or your violation of any law or third-party rights.
10. Force Majeure
    We are not responsible for delays or failures caused by events beyond our reasonable control, including extreme weather, natural disasters, epidemics, war, strikes, outages, legal restrictions, or network failures.
11. Termination
    You may stop using the Services at any time. We may suspend or terminate access (with or without notice) for violations, fraud, non-payment, legal risk, or operational reasons. Sections intended to survive termination (e.g., intellectual property, limitations of liability) will continue to apply.
12. Governing Law & Dispute Resolution
    These Terms are governed by the laws of the jurisdiction where MXJek is established, without regard to conflict-of-law principles. If required by local consumer law, the mandatory protections of your place of residence will apply.
    Disputes will first be addressed through our support team. If unresolved, they will be submitted to the competent courts/tribunals of that governing jurisdiction unless applicable law requires otherwise. Nothing here prevents you from seeking relief in small-claims court where permitted.
13. Changes to These Terms
    We may update these Terms from time to time. Material changes will be indicated by updating the “Last updated” date and, where required by law, by additional notice. Continued use of the Services after changes means you accept the revised Terms.
